License Fee

• The music-maker grants a licence to the buyer for use of the musical work in return for payment of the sale price




Licence Terms

• Upon payment the music-maker grants the buyer the right of use throughout the world and in accordance with this agreement




Warranty

The music-maker confirms the following:-

• They are the copyright owner or has been granted authority by the copyright owner(s) to upload the music
• The music does not infringe any intellectual property rights or the rights of any third party
• The music does not contain any unauthorized samples and any samples used are royalty-free and cleared for use
  The music-maker shall indemnify the buyer from all losses and costs arising from any claims from third parties
• The music-maker confirms BuyBackingTracks.com is not responsible for any copyrighted material uploaded and we have no way of knowing if a recording contains unauthorized samples and cannot be held liable for any sampled or falsely presented recording




Samples and Copyrighted Content

You confirm, you are solely legally responsible for any copyrighted content uploaded.

You confirm, Muzicity Ltd is not responsibility for any copyrighted content uploaded and Muzicity Ltd have no way of knowing if a recording contains unauthorized samples or if copyrighted content has been uploaded and Muzicity Ltd cannot be held liable for any unauthorized samples or falsely presented uploaded content.

You confirm, Muzicity Ltd will not be held responsible financially for any copyrighted content uploaded and Muzicity Ltd is free and harmless against any and all claims.



Income

• Sales income is paid instantly via PayPal
• Free subscribers keep 70% of their sales income
• Paid subscribers keep 100% of their sales income
• Music-makers are entitled to recieve Performance Royalties




Uploads

• The music-maker agree to upload
  
• Songs and/or Instrumentals as a stereo music file - Mp3 or Wav file


• For a Stems
  The Song or Instrumental as a stereo music file - Mp3 or Wav file
  And each of the instruments on their own separate music file


• The music-maker agrees that no offensive or sexual explicit material or content will be uploaded to this website and BuyBackingTracks.com has the right to remove any material or content it deems as inappropriate




Publishing and Credits

Music-makers are entitled to Performance Royalties

• It is the responsibility of the music-maker to ensure their music has been registered with their copyright collection society in order to receive Performance Royalties
• Music-makers can still be uploaded their music even if they are not a member of a copyright collection society
• The correct publishing and copyright information must be provided
• BuyBackingTracks.com absolves all responsibility in regards to any Performance Royalties
• The music-maker should be credited in any distribution, performance or otherwise disseminate to the public of their music
• The music-maker retains ownership of the copyright and shall have the right to re-sell the music, (expect when the music has been sold as an Exclusive)




General

• BuyBackingTracks.com will use reasonable efforts to keep all music or content safe and stored on encrypted servers but we cannot be held responsible for the loss or damage of any music or content uploaded to its website
• The music-maker agrees that BuyBackingTracks.com will not be held responsible financially for any losses incurred by the loss or damage of any data or content uploaded to its website, this includes but not limited to loss of earnings
• The music-maker agrees to defend, indemnify and hold BuyBackingTracks.com free and harmless against any and all claims, suits, liability, loss, damage, judgments, recoveries, costs, expenses and attorney's fees made or brought, paid, or incurred directly or indirectly by any party in connection with the uploading of music or content
• By subscribing and uploading your content to BuyBackingTracks.com the music-maker gives us permission to use their content for promotional reasons
• Paid subscribers acknowledge subscription payments are not refundable for any reason
  Subscription can be cancelled at any time via the Dashboard




The music-maker grants the buyer the right to use Backing Tracks as follows:-

• Sync Licensing -
  Synchronize with multimedia productions.
  Sync to animations, games, apps, film, internet videos and all other forms of media


• Add additional sounds and instruments (Instrumentals only)
• Add vocals (Instrumentals only)


• Edit by shortening, stretching or looping


• Sell up to 5,000 products that contains the music
  Products include animations, games, apps, films, internet videos and all other forms of media
  Products over 5,000 units will require an additional license from the music-maker


• Use for video and film productions not exceed £1,000,000
  Productions over £1,000,000 requires an additional license from the music-maker


• Use for radio, internet and television advertising


• Broadcast on radio and television networks
• Broadcast on internet websites


• Use for public performance or background music to an audience


• Unlimited use the music in accordance with this agreement


• The music-maker should be credited in any distribution or performance of their music
